vs.

OWEN A. ALLRED, DENNIS E. MATTHEWS,

JOHN C. PUTVIN, JEFFREY J. NORMAN,

JAMES E. SANDMIRE, LAMOINE JENSON,

et. al.

CORPORATION OF THE PRESIDING ELDER

OF APOSTOLIC UNITED BRETHREN,

COMMUNITIES OF APOSTOLIC UNITED

BRETHREN, UNIFIED INDUSTRIES, INC.,

RED CEDAR CORP., JOHN GALT AND

ASSOCIATES, INC., JOHN D’ANACONIA GALT

et. al. Defendants.

Owen A. Allred is the presiding elder of Apostolic United Brethren, affectionately called AUB, a polygamist group with a reported,  7000 members.  Mr. Allred is revered by his acolytes as having the same authority as Joseph Smith -- Prophet, Seer and Revelator.  The priesthood of AUB teach that they are the only people on earth living all of God’s laws, therefore they must possess the allusive, exclusive keys mentioned in the 7th verse of the 132nd section of the Doctrine & Covenant.

On Sunday,  January 13, 2002, during Sacrament Meeting, Allred, who is in his eighties, informed the followers of AUB that LaMoine Jenson was his choice to succeed him after his death.   That endorsement promoted LaMoine Jenson to Prophet, Seer and Revelator.  According to Mormon doctrine, there is no greater calling on the face of the earth.

The following is a summery taken from the “amended complaint” filed December 22, 1997.

Defendants Matthews and Putvin were commissioned by the plaintiff and her agent, John Shugart to purchase the D.I. Ranch (Deseret Inn Ranch) in southern Utah.  The purchase price was 1.5 million dollars.  Putvin’s fee for negotiating the purchase was $40,000.00.

John C. Putvin, Co- Defendant
Hill vs. Allred et al

Cash money was turned over to defendants, Matthews and Putvin in three installments: $40,000.00 in advance to Putvin. $1,000,000.00 cash on November 12, 1989 and $500,000.00 cash on December 7, 1989.  It is alleged that after receiving the first one million, defendants Matthews and Putvin went to their priesthood leader, Owen A. Allred and the three priesthood men hatched a  conspiracy to deprive the plaintiff and her agent of the money and convert it to their own use.  This meeting was tape recorded.  A copy of the tape is in the possession of the plaintiff’s legal staff.

Dennis Matthews
Co-Defendant
Hill vs. Allred et al

“Plaintiff alleges on information and belief that Mr. Matthews and Mr. Putvin, under the direction of Owen A. Allred and with the assistance of James E. Sandmire, Jeffery J. Norman and J. LaMoine Jenson did conspire to convert (Civil Conspiracy) money received from Ms. Hill’s agent, Mr. Shugart, to their own use and / or benefit and to Ms. Hill’s detriment.”

Ms. Hill alleges that the defendants did convert her money to their own use and in so doing committed fraud and constructive fraud in the concealment and misrepresentation of the conversion

Plaintiff alleges that on or about November 13, 1989, that Mr. Matthews, Mr. Putvin and Owen A. Allred, acting for himself an as the Presiding Elder of Apostolic United Brethren did meet and conspire to “fraudulently convert money received from Ms. Hill’s agent, John Shugart, to their own use.”

The fraudulent conversion of the money meets the definition of “Theft by Deception” as outlined in the Utah Criminal Code.

The defendants “have acquired one million five hundred forty thousand dollars ($1,540,000.00) of money received from Ms. Hill’s agent, Mr. Shugart, by fraudulent conversion and / or concealment and / or receiving stolen property.

On or about November 20, 1989, defendants Allred and Jenson, representing the Red Cedar Corporation, a subsidiary of Owen A. Allred and / or the A.U.B., gained title to the Granite Ranch from Lorin L. Moench, President of Thousand Peaks Ranches, by virtue of funds laundered from, converted from, and / or directly or indirectly, received by Matthews and Putvin from Ms. Hill’s agent, Mr. Shugart.

That defendant Matthews purchased with funds belonging to Ms. Hill on or about November 24, 1989 a 1989 Honda, Accura, (Vin) JH4K458KC009196, from Robert C. Johnson for $21,000.00, paid in cash; and that defendant Matthews was driving said vehicle when on or about December 7, 1989, he picked up the final $500,000.00 in cash of the $1,540,000.00 total.  Concealed from Shugart and the plaintiff was the fact that Matthews, at that time, was an ordained bishop acting under the direction of Owen A. Allred.

Dennis Mathews
and
Jeffery J.  Norman
Defendants-

Hill vs. Allred
et al

(Norman imprisoned for money laundering)

Owen A. Allred is accused of laundering $20,000.00 to John d’Anaconia Galt, alias John C. Putvin.  J. LaMoine Jenson is accused of laundering $30,000.00 to John d’Anaconia Galt through Jenson Lumber.  Jeffery J. Norman and John C. Putvin are accused of laundering over a half million dollars into Last Resort Enterprises, Inc., an alter ego corporation of John C. Putvin.

A used car lot located at 4659 So. State, Murray , Utah was purchased with laundered money into Last Resort Enterprises, Inc. in the name of James E. Sandmire.  A corporation, Diamond Automotive Specialities, Inc., was created by Sandmire to sell used cars.  Putvin and Jenson were at times officers in this and other corporations.  It is alleged by the plaintiff that two “Assignment of Trust Deeds” totaling $500,000.00, recorded in the Salt Lake County Recorder’s Office,  were created to launder from Last Resort Enterprises, Inc., via James Sandmire into Apostolic United Brethren in the name of J. LaMoine Jenson, Sole and Exclusive Agent for Apostolic United Brethren.

“Plaintiff alleges on information and belief that the A.U.B. qualifies as a racketeering enterprise under the Utah Criminal Code “Pattern of Unlawful Activity Act” U.C.A. 76-10-10601 et. seq. Defendants affiliated with the A.U.B. have committed at least three acts in violation of the “Pattern of Unlawful Activity Act.”

It took three years of intensive investigation by John R. Llewellyn and Rod Williams, former Secret Service Agent,  to build the case.  The information disclosed  in the complaint is only the tip of the ice berg of the total story which will eventually be told by John R. Llewellyn after the final conclusion of the law suite in a book entitled, Believer Beware.  The trial date for this law suit has been set for October 28, 2002.

In consideration of the defendants, they deny all of the allegations and have challenged the plaintiff to show that the money even existed.

The law suit summarized above is one of the most convoluted but fascinating investigations the author, John R. Llewellyn, has ever tackled.  Without intentionally prejudicing the defendants, it is only fair to appraise the reader of subsidiary information that smacks at the uniqueness of  this law suit.

Owen A. Allred, Co-Defendant

According to evidence uncovered by investigators, all of the alleged criminal acts committed by the defendants were sanctioned by the polygamist God through Owen A. Allred, causing that God to be a co-defendant, however, God was not named on the complaint.

The Salt Lake County Sheriff’s Office and IRS investigated the money laundering of Putvin and Norman.  A federal grand jury in a True Bill indicted Putvin and Norman but only Norman and his plural wife, Sarah, were prosecuted.  It is believed a deal was made with Putvin.  The security fraud charges that had been filed against Norman were dismissed after his guilty plea for structuring.  Norman went to prison.

The DI Ranch [Deseret Inn Ranch] is alleged to have been the Las Vegas mob’s recreational ranch during the fifties.

In October 1999, Diamond Automotive Specialties Inc, the used care lot believed purchased and financed with the Plaintiff’s money was shut down by the Utah State Motor Vehicle Enforcement Division for selling stolen cars.

Tom Green was the paralegal for the plaintiff’s attorney, Don Redd.
